Gregg Owens

For over thirty-five years, Gregg Owens has handled a wide variety of complex business and commercial litigation in state and federal courts, in arbitration proceedings, and before various regulatory agencies. He has been Board Certified in Civil Trial Law by the Texas Board of Legal Specialization continuously since 1981. His broad experience in civil litigation also serves to inform another important aspect of his practice – counseling clients in their efforts to resolve emerging business disputes before they become lawsuits. Mr. Owens’ years of trial experience enhances the potential for settlement of developing disputes, but when a trial is required, it provides the client with the assurance of being represented by a sound and seasoned trial lawyer.

 

Prior to forming Hays & Owens, he was a partner in the Midland, Texas firm known as Bullock, Scott, Neisig & Owens for fourteen years. Mr. Owens has made presentations for programs sponsored by the State Bar of Texas and University of Houston Law Center as well as written numerous papers. Mr. Owens is an experienced mediator serving at the request of litigants and courts. He received his law degree from Texas Tech University Law School in 1973, and his B.A. from the University of Texas in 1970. He is admitted to practice before all Texas state courts and before federal courts of the 5th Circuit and the Western, Northern and Eastern Districts of Texas.

 

Mr. Owens is a Fellow of the Litigation Counsel of America.The LCA is a trial lawyer honorary society composed of less than one-half of one percent of American lawyers. Mr. Owens is also a Fellow of the Texas Bar Foundation; Former Board Member of Litigation Section of the Travis County Bar Association; and Past Director of Texas Young Lawyers Association. He is also a Member of the Advisory Board of Governors of the Permian Basin Area Foundation, a Past Chairman of the Board and Past Vice President for Economic Development of the Midland Chamber of Commerce.

  • Natural Resources - Maintenance of oil, gas and mineral leases, surface damages, operator and non-operator issues, oil and gas royalty underpayment, enforcement of joint operating agreements, surface owners and producer issues, preferential rights to purchase, enforcement of take or pay provisions of gas purchase contracts, enforcement of gas processing agreements, maintenance of easements and licenses, breach of gas supply contracts, disputes between pipeline owners and producers, representation of oil and gas operators, interest owners, and pipelines in contested proceedings before the Railroad Commission of Texas, disputes between parties over water rights and development, and oil and gas leasing.
  • Estate and Probate - Defense of lawsuits against private trusts, commercial bank trust departments, and individual trustees brought by beneficiaries and other claimants under wills and trust instruments.
  • Real Estate - Acquisition and sales of rural real estate and commercial real property, commercial leases, condemnations, easements and rights of way, trespass and conversion of timber, and real estate brokerage services.
  • Representation of Licensed Professionals - Representation of accountants and attorneys before administrative boards and professional associations.
  • Environmental - Water and surface pollution claims, Endangered Species Act, water district development contests.
  • Manufacturing - Contracts for specially manufactured machinery and products and related Uniform Commercial Code issues.
  • Education - Defense of institutions of higher learning involving employment, contracts, and insurance coverage.
  • Employment - Wrongful discharge, retirement benefits, employment contracts, and stock options.
  • Insurance - Personal injury defense, products liability, premises liability, property, coverage issues, and life insurance.
  • Municipal - Election contests, zoning and use permits, and contracts with municipal entities.

  • Arbitration of farmout agreement for oil and gas producer involving defense of damage claims and enforcement of preferential rights to acquire mineral interests in recent shale plays.
  • Enforcement of stock option agreement on behalf of former President of a company.
  • Defense of damage claims and enforcement of accommodation doctrine as related to surface timber operations.
  • Representation of landowners before ground water conservation district regarding water supply company's application for drilling certain water supply wells potentially deleterious to aquifer below client's land.
  • Defense of oil and gas company in claim of lost and unaccounted for gas issues before the Railroad Commission of Texas.
  • Enforcement of reserve incentive plan for management employees.
  • Representation of Texas General Land Office in pipeline rate case litigation before State Office of Administrative Hearings.
  • Enforcement of obligations under a gas processing agreement between gas producer and gas processor.
  • Enforcement of contract for specially ordered oil field pipe manufacturing equipment.
  • Defense of college sued for wrongful discharge of college administrator.
  • Enforcement of payment obligations of gas purchase contracts.
  • Area of mutual interest litigation of natural gas processing agreements.
  • Defense and prosecution of municipal zoning regulations and federal license to rehabilitate and possess wildlife under the Endangered Species Act.
